Welcome to KBA Home Living (www.kbahomeliving.com). These Terms and Conditions (“Terms”) govern your use of our website and the purchase of any products. By accessing our site or placing an order, you agree to be bound by these Terms.

1. LEGAL COMPLIANCE & FLORIDA GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the site shall be resolved exclusively in the state or federal courts located in [Insert Your County, e.g., Miami-Dade] County, Florida.

2. ACCURACY OF INFORMATION & PRICING

KBA Home Living strives for 100% accuracy; however, errors in pricing, descriptions, or images may occur.

  • We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

  • We reserve the right to refuse or cancel any orders placed for products listed at an incorrect price, even if the order has been confirmed and your credit card charged.

3. SHIPPING, DELIVERY & RISK OF LOSS

All items purchased from KBA Home Living are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. * Delivery Dates: Shipping dates are estimates only and cannot be guaranteed.

4. SPECIALIZED RETURN & DAMAGE POLICY

By purchasing from KBA Home Living, you expressly acknowledge and agree to our Return Policy:

  • 30-Day Limit: Returns and exchanges must be initiated within 30 days of delivery. After 30 days, all sales are final.

  • 1-Day Damage Reporting Rule: Because home improvement materials (tiles, fixtures, vanities, etc.) are susceptible to transit damage, you must report any damage within one (1) business day of delivery.

  • Documentation Required: You must provide clear photographic evidence of the damaged product and the shipping packaging. Claims without photos or made after the 24-hour window will be denied.

  • Refund Timeline: Approved refunds will be processed within 5–7 business days after we have verified the return is valid or the damage claim is resolved.

5. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, KBA HOME LIVING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, INSTALLATION COSTS, OR PROPERTY DAMAGE ARISING FROM THE USE OR INABILITY TO USE OUR PRODUCTS.

Our total liability to you for any claim shall not exceed the purchase price of the specific product that gave rise to the claim.

6. PRODUCT INSTALLATION & SAFETY

KBA Home Living provides products only. We do not provide installation services. We strongly recommend that all home improvement products (electrical, plumbing, or structural) be installed by a licensed and insured Florida contractor. KBA Home Living is not responsible for any damage or injury resulting from improper installation or “DIY” projects.

7. INTELLECTUAL PROPERTY

All content on www.kbahomeliving.com, including text, graphics, logos, and images, is the property of KBA Home Living and is protected by United States and international copyright laws. Also, some photo’s are from our vendor’s and cannot and should not be duplicated. 

8. DISPUTE RESOLUTION & ARBITRATION

In the event of a dispute, you agree to first contact us to attempt an informal resolution. If the dispute is not resolved within 30 days, both parties agree to binding arbitration in the State of Florida, rather than jury trials or class actions.

9. FLORIDA “NOTICE TO OWNER” PROVISIONS

If you are a contractor purchasing materials for a project, you acknowledge your responsibility under Florida’s Construction Lien Law (Chapter 713, Florida Statutes) to provide necessary notices to property owners to protect your lien rights.
